The agency commission is paid in the amount of 2-4% of the price of the real estate that is the subject of acquisition, and is paid by the principal (the user of the brokerage service).
For each property, the commission is agreed with the client, depending on the service the client wants, or the nature of the legal transaction.
a) When purchasing or acquiring real estate in the Republic of Croatia, the acquirer of real estate is obliged to pay real estate transfer tax (PPN) in the amount of 3% of the purchase price of the real estate or the estimated value of the real estate by the Tax Administration of the Republic of Croatia.
b) When value added tax (VAT) is calculated on the real estate being acquired, the acquirer does not pay real estate transfer tax (RPT).
In the Republic of Croatia, notaries are obliged to submit a copy of the purchase contract to the competent Tax Administration of the Republic of Croatia. For those properties on which value added tax (VAT) has not been calculated, the Tax Administration will send buyers a Decision on the obligation to pay real estate transfer tax (PPN).
Yes, foreigners can buy real estate in Croatia, but the conditions depend on the citizenship of the acquirer:
a) Foreigners who are citizens of European Union member states can purchase real estate in the Republic of Croatia under the same conditions as citizens of the Republic of Croatia.
b) Foreigners who are citizens of countries outside the European Union must first obtain consent for the purchase (acquisition of ownership) of real estate in the Republic of Croatia from the Ministry of Justice of the Republic. The said consent is subject to reciprocity.
This means that only non-EU citizens coming from countries where Croatian citizens can acquire ownership of real estate (with the principle of reciprocity) can initiate an administrative procedure and request approval from the Ministry of Justice of the Republic of Croatia. Furthermore, all foreigners must obtain a Personal Identification Number (OIB), and depending on their country of origin, they may have restrictions on the purchase of agricultural or forest land.
Yes, an OIB (personal identification number) is mandatory for all real estate buyers in Croatia, including foreign citizens.
